Supreme Court, 5 February 2020, decision no. 2458 (Italy)

By adopting an intersectional approach, in a case involving an asylum claimant from Senegal the Supreme Court stated that the assessment of credibility shall ensure appropriate consideration of the specific circumstances of the case, the social class, the life experiences, the sex and the age of the claimant as well as patterns of internalised homophobia. Moreover, it rejected the idea that SOGI claims could be assessed as matters of private life, with the consequence of bringing these claims outside the scope of legislation on international protection.
