Third Section, Application no. 56390/21, M.I. v. Switzerland, lodged on 22 November 2021
Summary
On 4 May 2022, the ECtHR communicated a case against Switzerland. The case concerns the return of an Iranian national who claimed asylum based on his sexual orientation. The applicant alleges that his expulsion would put him at risk of treatment contrary to Articles 2 and 3 of the Convention and that the rejection of his asylum claim breached his rights under Articles 8, 13 and 14. Switzerland denies the potential risk and defends that the return to Iran would not pose any risk of degrading treatment or unbearable psychological pressure.
