Abstract

This paper focuses on the right to family unity of beneficiaries of international/national protection and asylum seekers with same-sex spouses or partners. We focus, firstly, on the case law of the Court of Strasbourg regarding the notion of ‘family’ and the right of same-sex couples to obtain the legal recognition of their union. Subsequently, we proceed to reconstruct the European Union’s law that applies in this area. Finally, we analyse the Italian legislation with regard to the right to family reunification and to a civil union of beneficiaries of international/national protection and asylum seekers with same-sex partners.
