Supreme Court, 9 January 2020, decision no. 267 (Italy)

With decision no. 267/2020, the Italian Supreme Court rejected the decision of the Court of Appeal of Venice to uphold the denial of refugee status to a Nigerian asylum claimant, primarily for lack of plausibility and credibility of the story. By confirming its consolidated case law, the Supreme Court asks the Court of Appeal of Venice to reconsider the claimant’s case in light of its principle on SOGI persecution, credibility and role of the judge in asylum appeals.
