Supreme Court, judgment 4522/2015 (Italy)

Supreme Court, judgment 4522/2015 (Italy)

Summary

In this judgment, the Italian Supreme Court affirmed that an asylum seeker fleeing persecution on grounds of his sexual orientation may be prevented, for psychological reasons, from declaring the real reason of persecution in his country in his/her first request. National authorities have the duty to consider all aspects of the case in any circumstance, irrespective of when the asylum seeker discloses the real reason of persecution.
