Abstract
Examines the use of the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004 s.8, which allows asylum decision makers to take into account behaviour that damages the credibility of an asylum seeker’s claim. Notes behaviour to be assessed under s,8, namely as regards the documentation provided by the asylum seeker, their replies to questions asked by the deciding authority, whether they had a reasonable opportunity to claim in another “safe country” before arriving in the UK, and whether their claims came after notification of other immigration maters. Advises practitioners on how to assert the credibility of their clients, with reference to the specific circumstances to be found in many potential countries of origin.
